AGREEMENT TO OUR TERMS
We are (“Firebird”, “Javan”, "Company," "we," "us," "our") Firebird Ventures Pte Ltd, a company incorporated under the laws of Singapore, with its principal place of business at 85 Coronation Road West, Singapore 269293, SINGAPORE. We operate the Javan application, as well as any other related products and services.
These Terms and Conditions ("Terms") govern your use of the Javan mobile application and its associated Application (collectively, the "Application"). The Application provides an online platform for users to list, discover, and connect for the purpose of buying and selling used motorbikes. By accessing or using the Application, you agree to be bound by these Terms.
Javan acts solely as a neutral platform to connect potential buyers and sellers of motorbikes. We are not a party to any transaction or agreement that may be formed between users of the Application. We do not own, inspect, or hold any of the motorbikes listed, nor are we involved in the actual sale, transfer of ownership, or any related negotiations.
These Terms and Conditions ("Terms") govern your use of the Javan mobile application and its associated Application (collectively, the "Application"). 1. Acceptance of Terms
By creating an account, listing a motorbike for sale, or contacting a seller through the Application, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations of the Republic of Singapore.
2. User Accounts and Eligibility
To use the full features of the Application, you must register for an account. You must be at least 18 years old and have the legal capacity to enter into bindingcontracts. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process.
3. User-Generated Content and Listings
You are solely responsible for all content, including images, descriptions, and contact information, that you upload, post, or transmit through the Application ("User Content").
When listing a motorbike for sale, you represent and warrant that:
● You are the legal owner of the motorbike and have the full right and authority to sell it.
● All information provided in the listing is accurate, complete, and not misleading.
● The motorbike has not been illegally modified and complies with all applicable regulations.
● You will promptly remove the listing once the motorbike is sold.
Javan reserves the right, but not the obligation, to review, screen, or remove any User Content that violates these Terms or is otherwise deemed inappropriate.
When listing a motorbike for sale, you represent and warrant that:

Javan reserves the right, but not the obligation, to review, screen, or remove any User Content that violates these Terms or is otherwise deemed inappropriate.
4. Prohibited Activities
You may not access or use the Application for any purpose other than that for which we make the Application available. The Application may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.
As a user of the Application, you agree not to:
● Systematically retrieve data or other content from the Application to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
● Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
● Circumvent, disable, or otherwise interfere with security-related features of the Application.
● Use any information obtained from the Application to harass, abuse, or harm another person.
● Make improper use of our support Application or submit false reports of abuse or misconduct.
● Engage in unauthorized framing of or linking to the Application.● Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use of the Application.
● Upload any content, word, picture which can be offensive or inappropriate for the other users of the Application
Javan reserves the right, but not the obligation, to review, screen, or remove any User Content, and Suspend or Terminate any account that violates these Terms or is otherwise deemed inappropriate.

Javan's role is strictly limited to providing the platform for users to connect. You acknowledge and agree that:
● Javan does not endorse any user or any motorbike listed on the Application.
● Javan is not responsible for the accuracy of any User Content.
● Javan is not involved in and bears no responsibility for the communication, negotiation, or any subsequent transaction between users.
● Javan does not guarantee the quality, safety, legality, or roadworthiness of any motorbike listed.
● Javan does not endorse any user or any motorbike listed on the Application.
● Javan is not responsible for the accuracy of any User Content.
● Javan is not involved in and bears no responsibility for the communication, negotiation, or any subsequent transaction between users.
● Javan does not guarantee the quality, safety, legality, or roadworthiness of any motorbike listed.
6. Legal and Regulatory Compliance
For Sellers: You are responsible for ensuring that the sale of your motorbike complies with all applicable Indonesian laws and regulations. This includes, but is not limited to, matters related to the process of transferring vehicle ownership at the Samsat (One-Stop Administration System) office and the Indonesian National Police (Polri).
For Buyers: You are responsible for conducting your own due diligence before entering into any agreement to purchase a motorbike. This includes verifying the ownership, condition, and legal status of the vehicle.

7. Consumer Protection Law
Please be aware that Law No. 8 of 1999 concerning Consumer Protection ("Consumer Protection Law") in Indonesia generally applies to transactions betweena business actor and a consumer (B2C). As Javan is a platform for consumer-to-consumer (C2C) transactions, any rights or legal remedies under the ConsumerProtection Law may not apply to transactions conducted between users of this Application. Both buyers and sellers should be aware of this distinction.
8. Disclaimers and Limitation of Liability
The Application and all its content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied.Javan expressly disclaims all liability for any loss or damage, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with:
● Your use of or inability to use the Application.
● Any transaction or interaction between users.
● Any errors, inaccuracies, or omissions in any User Content.
● The condition, legality, or fitness for a particular purpose of any motorbike listed on the Application.
To the fullest extent permitted by law, Javan's total liability to you for any and all claims arising out of or relating to these Terms or your use of the Application is limited to the amount of fees, if any, paid by you to Javan in the 12 months preceding the claim.

9. Indemnity
You agree to indemnify and hold harmless Javan, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Application or your violation of these Terms.
10. Dispute Resolution
Any disputes arising between users of the Application are to be resolved directly between those users. Javan has no obligation to mediate or resolve any such disputes.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be governed by and construed in accordance with the laws of Singapore.

11. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
● Using the Application for any illegal purpose or in violation of any local, state, national, or international law.
● Posting any User Content that is false, misleading, defamatory, obscene, or otherwise objectionable.
● Harassing, threatening, or otherwise intimidating other users.
● Attempting to interfere with the proper functioning of the Application, in accordance with the Law on Electronic Information and Transactions (UU ITE).
● Using the Application for any illegal purpose or in violation of any local, state, national, or international law.
● Posting any User Content that is false, misleading, defamatory, obscene, or otherwise objectionable.
● Harassing, threatening, or otherwise intimidating other users.
● Attempting to interfere with the proper functioning of the Application, in accordance with the Law on Electronic Information and Transactions (UU ITE).
12. Modification of Terms
Javan reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Application. Your continue use of the Application after such notice constitutes your acceptance of the new Terms.
13. Termination
1. Javan may, in its sole discretion, suspend or terminate your account and access to the Application at any time and for any reason, without prior notice or liability.
2. In the event of suspension or termination of the account, or removal of a listing by Javan, for infringement of these Terms, no refund will be given for listings previously paid, independently of any duration left for the listings previously paid.

14. User Data
We will maintain certain data that you transmit to the Application for the purpose of managing the performance of the Application, as well as data relating to your use of the Application. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Application. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.
15. Electronic Communications, Transactions, and Signatures
Visiting the Application, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Application, satisfy any legal requirement that such communication be in writing.

You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records.

You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records.
16. MISCELLANEOUS
These Terms and any policies or operating rules posted by us on the Application or in respect to the Application constitute the entire agreement and understanding between you and us.
Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
We may assign any or all of our rights and obligations to others at any time.
We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Terms or use of the Application.
You agree that these Terms will not be construed against us by virtue of having drafted them.
You waive any and all defences you may have based on the electronic form of these Terms and the lack of signing by the parties hereto.
Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
We may assign any or all of our rights and obligations to others at any time.
We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
